The Website hereinafter “www.wowpromo.com.my” or “we” or “our”) is operated by AQM Creative & Communication Sdn Bhd, is located at Lot 58546, Jalan CJ 1/1,

Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this Website. 

Any person who wants to access the Website to purchase goods or services that are provided (hereafter known as the “Products & Services”) must accept the Terms and Conditions herein. The Terms and Conditions are binding for each and every time the Products and Services are purchased from the Website.  

You agree with, and accept all of the Terms and Conditions contained herein and the Privacy Policy, which include those Terms and Conditions expressly set out below and those incorporated by reference, before you may become a purchaser or customer of wowpromo.

• Eligibilityto Purchase/ Buy  

Our products and services offered are available only to, and may only be used by individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to children (persons under the age of 18) or to temporarily or indefinitely suspended wowpromo customers. If you are under the age of 18, you can use this service only in conjunction with, and under the supervision of your parents or guardians. If you do not qualify, please do not use our Website. Further, your wowpromo account (including feedback) may not be transferred to another party.  

• Payment

There is no joining fee to use wowpromo.com.  

For products and services listed for sale through our Website, you have an opportunity to review and accept the prices that you will be charged. We may change our Prices for our products and services offered in the Website from time to time. However, we may choose to temporarily change our Prices and Return Policy and the handling/ delivery fees for our additional delivery charges, if any for promotional events and such changes are effective when we post a special ad-hoc or festive promotion on the Website. We may in our sole discretion change some or all of our products and services offered at any time.  

In the event, we introduce new products or services, the prices for that product or service are effective at the launch of the service. Unless otherwise stated, all Prices are quoted in RM (Ringgit Malaysia), which includes courier delivery, unless otherwise stated. You are responsible for paying all the Prices shown in the Website and all applicable statutory taxes, if any via a valid Credit Card.  
 
wowpromo may from time to time review and change on how the Public can access the Website. Such changes will be posted on the Website and shall become binding once the information is uploaded to the Website.  

• wowpromo.comis Only a Virtual Venue to conduct Purchases 

wowpromo.com is a retailer, although we are commonly referred to as an online retailer         Website. This Website acts as a virtual venue to allow anyone to buy or purchase, at anytime, from anywhere, in a fixed price format.  We have no control over the quality, safety or legality of the items advertised, the truth or accuracy of the products and services, as we are not the manufacturers of the products and services listed in the Website.  
 
We are unable to control the information provided which is made available by the respective manufacturers of the products and services offered. By using this Website, you agree to accept such risks and wowpromo is not responsible for the acts or omissions of the manufacturers or product owners listed in the Website.   

Note that all graphics displayed in our listings/ Website may reside on our servers, but we do not and cannot control the images that are provided to us by our vendors and suppliers. Information and images posted may be offensive, harmful or inaccurate, and in some cases will be mislabeled or deceptively labeled.  

Whilst we try and ensure that all details, descriptions and prices, which appear on this Website are accurate, errors may occur.  

• Fraud/ Cheating/Phishing/ Scam 

By using this Website for a purchase transaction, you agree that wowpromo.com is: 

• a venue to buy products and services,  
• not responsible for any losses arising from Fraud, Cheating, Phishing or Scam from your buying transaction 

We are not responsible for any losses arise from Fraud, Cheating or Scam which arise from you clicking any of the banners appearing in wowpromo.com and related Website and re-directed to any third party Website for any transaction you have done with a third party.  

• Purchaser Identity Verification

To verify the accuracy of the purchaser’s information provided to us, we may employ many techniques to verify the information accuracy. However, because the purchaser verification on the Internet is difficult, wowpromo cannot and does not confirm each purchaser’s purported identity. To conduct a purchaser verification, we will request for a Malaysian Identification Card (IC) for Malaysian citizens or a valid Passport to be submitted via Email or FAX and also upon approval of the purchaser’s credit card transaction. 

• Release 

In the event that you have a dispute with one or more products or services you purchased on wowpromo, our officers, directors, agents, subsidiaries, joint–ventures and employees will be released from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. 

• Terms of Sale

By placing an order for an item or product or service in the Website, you agree to be bound by the conditions of sale included in the product or service description so long as those conditions of sale are not in violation of this Terms & Conditions or unlawful. Once, you made a purchase, you become the item’s lawful owner upon physical receipt of the item or service from wowpromo. Purchases are not retractable or be cancelled.  
 
For special promotional/ offers and markdown prices, the prices shown in the Website are based on availability and on first-come-first-served basis. 

• Buying/ PurchaseTransaction 

To buy or purchase item(s) you see on the Website, you must be of a legal age (18 years old and above) to buy or purchase on the Website. You must key-in the item/product or service you wish to purchase and the your personal details (name, mailing address, email address, contact telephone number (home, office & mobile contact telephone numbers) in the shopping cart section in the Website. 

All products and services sold in the Website will be based on the product or service description (product dimensions or size, model and colour must be the same for each item entered by the purchaser, at the shopping cart page). 

 
We reserve the right to not process a purchase transaction, if we found that:  
 
(a) Purchaser’s or Buyer‘s details and contact information is invalid, not contactable, or misleading or credit card details are invalid or fraudulent.  

(b) Vendors or Suppliers – For any other reason which is against our company policies, guidelines, terms and conditions, these vendors/ suppliers will be removed from our Website, if found to:

The Website is updated on a real time basis and is proprietary to wowpromo.

• Purchaser Privacy

We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent and we only use your information as described in the Privacy Policy. We view the protection of purchasers’ privacy as a very important business ethic.  

• Warranty

1. wowpromo purchasers/ customers are advised to examine the items purchased upon delivery. In case of faulty, damaged and/or defective goods, all purchasers MUST return the item/s or gift vouchers in the original packaging and courier plastic flyer (plastic bag) within 3 working days to Customer Service – wowpromo at Purchaser’s own cost. 

1. wowpromo gives no representation or warranty with respect to any product and/or service offered in the wowpromo Website. wowpromo gives no warranty with respect to the quality of the gifts/items/service or their suitability for any purpose. Where warranty is provided by the manufacturers, any inquiries, disputes or claims shall be forwarded directly to the manufacturers concerned.  

1. Gift vouchers and Shopping Vouchers are ONLY valid for use until the date specified on the gift/shopping vouchers or certificates. All unused vouchers/certificates shall, after the expiry date, be deemed null and void and will not be replaced. The use of the gift vouchers/ shopping vouchers is subject to the Terms and Conditions contained therein and are valid for use only at participating establishments.  

WE, INCLUDING OUR SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES AND OUR VENDORS/ SUPPLIERS PROVIDE THE www.wowpromo.com.my WEBSITE AND OUR PRODUCTS AND SERVICES “AS IS” AND ANY WARRANTY OR CONDITION, EXPRESSED OR IMPLIED OR STATUTORY. WE, OUR SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES AND OUR SUPPLIERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON- INFRINGEMENT.  

• Limit of Liability

IN NO EVENT SHALL WE, INCLUDING OUR SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES OR OUR SUPPLIERS BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR WEBSITE, OUR SERVICES OR THIS TERMS & CONDITIONS (HOWEVER ARISING, INCLUDING NEGLIGENCE).

• Notices

Except as explicitly stated otherwise, any notices shall be given by e-mail to feedback@wowpromo.com or to the e-mail address you provided to www.wowpromo.com.my during the purchase registration process or such other address as the purchaser party shall specify. The notice shall be deemed to have been given 24 hours after the e-mail is sent, unless the sending party is notified that the e-mail address is invalid. Alternatively, we may give you notice by certified mail and return receipt requested to the mailing address provided to www.wowpromo.com.my during the purchase transaction made in the shopping cart page. In such case, the notice shall be deemed to have been given three (3) days after the date of mailing.  
 
wowpromo may from time to time work with a party to offer our purchasers or customers certain products or services at our discretion. All wowpromo purchasers will be informed of such offers through email and certain information based on the purchaser’s name, email address and mobile or handphone numbers made available to us, solely for this purpose.  

• Force Majeure 

We shall not be liable for any delay or failure to perform our services where such delay is due to circumstances beyond our reasonable control of the parties. Such circumstances shall include but shall not be limited to strikes, work stoppages, lock-outs, damage to production plant, acts of clamity or acts of God such as lightning ,earthquakes, floods, storms, explosions, fires and any natural disaster, acts of war, terrorism, riots, sabotage, and any law, order regulation or other action of any government authority, regulatory body or agency thereof.

This Terms & Conditions shall be governed in all respects by the laws of Malaysia. As such, laws are applied to Terms & Conditions entered into and performed entirely within Malaysia and between Malaysian residents.  

If any provision of this Terms & Conditions is held to be invalid or unenforceable, that provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only, and in no way define, limit, construe or describe the scope or extent of such sections. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. This Terms & Conditions sets forth the entire understanding and Terms & Conditions between us with respect to the subject matter hereof.
